These Terms & Conditions (“Terms”) govern your use of the website and family communication service (the “Service”) provided by Enormous Technologies LLC (“Enormous Technologies,” “we,” “us,” or “our”), a Georgia limited liability company located at 340 Winn Park Court, Roswell, GA 30075. By using the Service you agree to these Terms.
The Service
The Service helps members of a family or household coordinate shared calendars, messages, tasks, and updates about family events. You are responsible for the accuracy of the information you enter and for maintaining the confidentiality of your account credentials.
Eligibility and accounts
You must be at least 18 years old to create an account. A family group is set up and administered by an adult account holder, who is responsible for the use of the account by the family members they invite.
Acceptable use
You agree not to use the Service to:
- violate any law or the rights of others;
- send unsolicited or unlawful messages;
- upload content you do not have the right to share;
- interfere with or disrupt the Service or attempt to gain unauthorized access to it.
SMS / text messaging program (“Family Updates”)
Enormous Technologies offers an optional SMS program called “Family Updates.” The program terms below form part of these Terms.
- Program description. If you opt in, we send SMS text messages containing updates, reminders, invitations, and important information about your family’s gatherings, celebrations, milestones, reunions, and other family-related events.
- How to opt in. Provide your mobile number and check the SMS consent box on our sign-up form; or verbally agree when speaking with our representative by phone; or text START or YES to our program number. Consent is not a condition of purchasing any goods or services.
- How to opt out. Reply STOP or UNSUBSCRIBE to any message at any time. You will receive one message confirming your opt-out and no further messages unless you opt in again.
- Help. Reply HELP to any message, email ken@enormtech.com, or call 404-993-3311.
- Message frequency may vary based on your family’s activity.
- Message and data rates may apply. Your mobile carrier’s rates apply to each message. Carriers are not liable for delayed or undelivered messages.
- Privacy. We will not share your mobile information with third parties or affiliates for their promotional or marketing purposes. See our Privacy Policy.
- Supported carriers may change, and the program may not be available on all carriers.
Fees
Paid features of the Service are billed as described at the time of purchase. Text messaging itself is provided at no additional charge by us, but your carrier’s message and data rates apply.
Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, timely, or error-free, and message delivery depends on factors outside our control, including carrier networks.
Limitation of liability
To the fullest extent permitted by law, Enormous Technologies will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising out of or relating to your use of the Service.
Changes to the Service or these Terms
We may modify the Service or these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above and, where appropriate, by additional notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
Termination
You may stop using the Service and close your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that could cause harm to us or others.
Governing law
These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. The state and federal courts located in Georgia will have exclusive jurisdiction over any dispute arising from these Terms or the Service.
